Valley News - Rehearing set for Monday on Claremont recycling facility

CLAREMONT — The Zoning Board of Adjustment has scheduled a rehearing for Monday on a request from the Massachusetts-based private equity firm that owns American Recycling on Industrial Boulevard for the board reconsider its decision from August to uphold the zoning administrator’s denial of expansion of the facility to allow it to accept construction and demolition material.

The board said in August that if construction and demolition material were allowed, it would change the facility from recycling to a transfer station, which is not allowed in the zoning district.

In Acuity Management’s six-page request for a rehearing, Jeffrey Christensen, Acuity’s attorney, noted that the ZBA said if the New Hampshire Department of Environmental Services classifies the proposed C&D operation as a recycling facility, then it would treat the business as such, which is permitted.

“Because the intent of the Decision appears to be to modify the zoning administrator’s decision and not to affirm it, the Applicant seeks clarification of the Decision,” Christensen wrote. “The Board’s decision expressly states that the City will be bound by a determination by DES that the Property is a recycling facility notwithstanding its acceptance of C&D.”

Acuity proposes to bring in about 500 tons of construction and demolition material a day and, after sorting for recycling, send the rest of the debris to Ohio by rail. The proposal has met with strong opposition from many residents, who have cited noise, dust, pollution and damage to city roads.

The rehearing is set for Monday at 7 p.m. in City Hall.
